Posted by coldtobi | 4 Jul, 2007, 23:12Just a short update:
There has a new verdict, confirming the one of the LG Hamburg see this article)
LG Frankfurt a. M., Urteil vom 22.02.2007, Az.: 2-3 O 771/06
Summary: A guy went on vacation, leaving the WLAN on. The WLAN was misused for illgegal filesharing, while the owner was on vacation and therefore proofable not the cuprit. But the sentence was guilty, as already in the other one sentence referenced in the other article. The argumention was basically the same: It is the duty to secure the network, and it is the duty to know which crimes can be done using the network. It is reasonable to the owner, to take precautions avoiding the infrigments. You see, the very same story as in Hamburg.
